TERMS OF USE AGREEMENT
This Terms of Use Agreement ("Agreement") governs the access to and use of the GoFlyAdventure platform (www.goflyadventure.com), an Online Travel Agency (OTA) intermediary platform operated by GoFlyAdventure LLC, a company registered in Albania with its registered address at Kompleksi "Turquoise Marina" - M13-3/33 Hamallaj Albania. 2010 Durrës, Albania.

GoFlyAdventure operates as a pure intermediary digital marketplace connecting travelers with third-party suppliers, including but not limited to hotels, resorts, vacation rentals, airlines, tour operators, cruise providers, destination management companies, transport providers, travel agents, event organizers, and other travel service providers.
1. Introduction
1.1 Purpose of the Platform
GoFlyAdventure is an online travel agency and intermediary platform that facilitates travel bookings by connecting travelers ("Users") with third-party travel service suppliers ("Suppliers"). GoFlyAdventure does not own, operate, manage, control, inspect, guarantee, or provide the travel products and services listed by Suppliers on the platform.
1.2 Acceptance of Terms
By accessing, browsing, registering on, or using GoFlyAdventure in any manner, you ("User") acknowledge that you have read, understood, and agree to be legally bound by this Agreement and all policies incorporated herein by reference, including the Privacy Policy, Cookie Policy, and any Supplier-specific terms.
1.3 Binding Agreement
This Agreement constitutes a legally binding contract between you and GoFlyAdventure LLC ("Company," "we," "us," or "our"). If you do not agree to these terms, you must not access or use the platform.
1.4 Electronic Consent
By using the platform, you consent to receive communications and enter into agreements electronically. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
1.5 Updates to Terms
We reserve the right to modify, amend, or update this Agreement at any time. Material changes will be communicated through the platform or via email. Continued use of the platform after such notification constitutes acceptance of the revised terms. The "Effective Date" at the top of this Agreement indicates when the most recent version took effect.
2. Definitions
- "Platform"
- The GoFlyAdventure website, mobile applications, APIs, and all related digital services operated by GoFlyAdventure LLC.
- "OTA"
- Online Travel Agency — a digital intermediary that facilitates travel bookings between Users and Suppliers.
- "Intermediary"
- The role of GoFlyAdventure as a facilitator of transactions between Users and Suppliers, without being a party to the underlying travel service contract.
- "User"
- Any individual or entity that accesses or uses the platform, including Travelers, Customers, and registered account holders.
- "Traveler"
- An individual who searches for, books, or consumes travel services through the platform.
- "Customer"
- The person or entity responsible for making a booking and payment on the platform.
- "Supplier"
- Any third-party provider of travel products or services listed on the platform, including hotels, airlines, tour operators, transport providers, and ancillary service providers.
- "Merchant of Record"
- The entity responsible for processing payments and issuing invoices for bookings made through the platform.
- "Booking"
- A confirmed reservation for a travel product or service made through the platform.
- "Reservation"
- A request to book a travel product or service, which may be subject to Supplier acceptance and confirmation.
- "Content"
- All text, images, videos, data, listings, descriptions, reviews, ratings, and other materials published on or through the platform.
- "User Content"
- Content submitted, posted, or uploaded by Users, including reviews, ratings, comments, photographs, and feedback.
- "Intellectual Property"
- All patents, trademarks, copyrights, trade secrets, database rights, design rights, domain names, and other proprietary rights.
- "Force Majeure"
- Any event beyond the reasonable control of a party, including natural disasters, pandemics, war, terrorism, government actions, cyberattacks, and transportation disruptions.
- "Third-Party Services"
- Services, websites, applications, or content provided by entities other than the Company or its affiliates.
- "Travel Product"
- Any travel-related service or product offered by a Supplier through the platform, including accommodations, flights, tours, transfers, activities, insurance, and visa services.
- "Payment Processor"
- A third-party service provider engaged by the Company to process payment transactions on the platform.
- "Personal Data"
- Any information relating to an identified or identifiable natural person, as defined under applicable data protection legislation.
- "Package"
- A pre-arranged combination of at least two different types of Travel Product for the purpose of the same trip, where those Travel Products are combined by GoFlyAdventure before a single contract is concluded, or where they are selected by the User and purchased under separate contracts from a single point of sale during a single booking transaction before the User agrees to pay, as defined under Directive (EU) 2015/2302 and equivalent applicable legislation, including the UK Package Travel and Linked Travel Arrangements Regulations 2018.
- "Linked Travel Arrangement" or "LTA"
- An arrangement, falling short of a Package, whereby a User books one Travel Product through the platform and is then facilitated in booking at least one additional, separate Travel Product from a different Supplier, where that additional Travel Product is booked within twenty-four (24) hours of the confirmation of the first booking, as defined under Directive (EU) 2015/2302 and equivalent applicable legislation.
- "Organizer"
- A trader who combines and sells or offers for sale Packages, either directly or through another trader, as defined under Directive (EU) 2015/2302. GoFlyAdventure does not act as Organizer of any Package unless expressly agreed in writing for a specific Travel Product or offer.
- "Retailer"
- A trader, other than the Organizer, who sells or offers for sale Packages combined by an Organizer, as defined under Directive (EU) 2015/2302.
- "Single Travel Service"
- A single Travel Product selected and booked by a User in one transaction that is not combined with any other Travel Product in a manner that constitutes a Package or a Linked Travel Arrangement.
- "ATOL"
- The Air Travel Organiser's Licensing scheme administered by the UK Civil Aviation Authority under the Civil Aviation (Air Travel Organisers' Licensing) Regulations 2012, applicable to certain flight-inclusive Packages sold to Users in the United Kingdom.
- "Seller of Travel Laws"
- The seller-of-travel registration, disclosure, bonding, and trust-account laws in force in certain states of the United States, including without limitation California, Florida, Hawaii, Washington, and Iowa, together with any successor legislation.
- "TICO"
- The Travel Industry Council of Ontario, or any equivalent provincial or territorial travel-trade regulator in Canada.
- "Australian Consumer Law" or "ACL"
- The Australian Consumer Law set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth), as administered by the Australian Competition and Consumer Commission (ACCC), and the equivalent consumer guarantee provisions of the Fair Trading Act 1986 of New Zealand.
- "African Consumer Protection Laws"
- Collectively, the consumer protection, electronic commerce, and travel-trade legislation of African jurisdictions in which GoFlyAdventure operates or provides its services, including the Consumer Protection Act 2008 of South Africa, the Federal Competition and Consumer Protection Act 2018 of Nigeria, the Consumer Protection Act 2012 of Kenya, and equivalent legislation in other African jurisdictions.
- "Consumer"
- An individual acting for purposes wholly or mainly outside that individual's trade, business, craft, or profession, as defined under applicable consumer protection legislation in the User's jurisdiction.
- "Trader"
- A person or entity acting for purposes relating to that person's trade, business, craft, or profession, whether acting personally or through another person acting in the trader's name or on the trader's behalf.
- "Mandatory Local Law"
- Any law, regulation, or rule of a User's or Supplier's jurisdiction that cannot be limited, excluded, or waived by agreement, and which applies notwithstanding any other provision of this Agreement.
- "Applicable Law"
- All laws, regulations, directives, and binding regulatory guidance applicable to GoFlyAdventure, a User, or a Supplier in connection with their use of, or activity on, the platform in the relevant jurisdiction.
- "GDPR"
- The General Data Protection Regulation (EU) 2016/679, and, where applicable, the UK General Data Protection Regulation as retained and amended under the Data Protection Act 2018 ("UK GDPR").
- "CCPA/CPRA"
- The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, and its implementing regulations.
- "POPIA"
- The Protection of Personal Information Act 4 of 2013 of South Africa and its implementing regulations.
- "PIPEDA"
- The Personal Information Protection and Electronic Documents Act of Canada and equivalent substantially similar provincial privacy legislation.
- "Digital Services Act" or "DSA"
- Regulation (EU) 2022/2065 of the European Parliament and of the Council on a Single Market For Digital Services.
- "E-Commerce Directive"
- Directive 2000/31/EC of the European Parliament and of the Council on certain legal aspects of information society services, including electronic commerce, in the Internal Market.
- "Consumer Rights Directive"
- Directive 2011/83/EU of the European Parliament and of the Council on consumer rights, as implemented in the national law of each European Union member state.
- "ODR Platform"
- The European Commission's Online Dispute Resolution platform established under Regulation (EU) No 524/2013, where applicable to disputes between Users and Suppliers established in the European Union.
- "VAT"
- Value Added Tax, Goods and Services Tax (GST), sales tax, or any substantially equivalent consumption tax imposed under the law of the relevant jurisdiction.
- "AML Laws"
- Anti-money laundering, counter-terrorism financing, and related financial crime legislation applicable to GoFlyAdventure, the Payment Processor, or a Supplier in the relevant jurisdiction, including customer due diligence and suspicious activity reporting obligations.
- "KYC"
- Know Your Customer identity verification procedures conducted to comply with applicable AML Laws and Sanctions Laws.
- "Sanctions Laws"
- The economic and trade sanctions, export control, and restricted-party laws administered by the United Nations Security Council, the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), the European Union, the United Kingdom, and other applicable national or supranational authorities.
- "Cross-Border Payment"
- A payment for a Travel Product processed in a currency, or through a payment method or Payment Processor, located in a jurisdiction other than the User's jurisdiction of residence.
- "Escrow Account" or "Trust Account"
- A segregated account maintained by GoFlyAdventure, a Supplier, or a third-party trustee to hold User funds in connection with a Package, Linked Travel Arrangement, or Seller of Travel Laws requirement, pending delivery of the relevant Travel Product.
- "Chargeback"
- A reversal of a card payment initiated by a User's card issuer or bank, whether or not GoFlyAdventure or the Supplier disputes the reversal.
- "Home Member State"
- The European Union or European Economic Area member state in which GoFlyAdventure or the relevant Organizer is established for the purposes of the Directive.
- "Standard Contractual Clauses" or "SCCs"
- The standard data protection clauses adopted by the European Commission, the UK Information Commissioner's Office, or other competent authority, for the transfer of Personal Data to jurisdictions outside the European Economic Area or United Kingdom that have not been recognized as providing an adequate level of data protection.
- "Adequacy Decision"
- A decision of the European Commission, the UK Government, or other competent authority recognizing that a third country, territory, or international organization ensures an adequate level of protection for Personal Data.
- "Regulator"
- Any governmental, statutory, or supervisory authority with jurisdiction over GoFlyAdventure, a User, or a Supplier in connection with the operation of the platform, including consumer protection agencies, data protection authorities, civil aviation authorities, financial conduct regulators, and tourism licensing bodies.
- "QKB"
- Qendra Kombëtare e Biznesit / the National Business Center of the Republic of Albania, the authority responsible for the registration and licensing of commercial entities, including GoFlyAdventure LLC, under Law No. 131/2015 "On the National Business Center," as amended.
- "IDP"
- The Information and Data Protection Commissioner of the Republic of Albania (Komisioneri për të Drejtën e Informimit dhe Mbrojtjen e të Dhënave Personale), the supervisory authority responsible for the enforcement of Albanian data protection legislation.
3. OTA GoFlyAdventure Intermediary Status
GoFlyAdventure acts solely as an intermediary platform facilitating transactions between Users and Suppliers. The following provisions clarify the scope and limitations of this intermediary role:
- GoFlyAdventure acts solely as an intermediary and facilitator. The Company is not a travel provider, tour operator, airline, hotel operator, transport company, or supplier of any travel product or service.
- GoFlyAdventure is not a party to the contract between the User and the Supplier. The contractual relationship for the delivery of travel services exists exclusively between the User and the Supplier.
- GoFlyAdventure is not responsible for the performance, quality, safety, legality, or suitability of any travel product or service provided by Suppliers.
- GoFlyAdventure does not guarantee the availability, accuracy, completeness, or timeliness of any listing, offer, price, description, photograph, or Supplier-provided information displayed on the platform.
- GoFlyAdventure does not guarantee the quality, condition, cleanliness, safety, or fitness for purpose of any accommodation, transport, tour, activity, or other travel service.
- GoFlyAdventure does not independently verify, inspect, audit, or guarantee the accuracy of all information provided by Suppliers. Information displayed on the platform is provided by the Supplier and may not be independently validated.
- The Supplier is solely responsible for delivering the travel product or service as described, complying with all applicable laws, maintaining required licenses and permits, and fulfilling obligations to Users.
4. EU Package Travel Directive and Linked Travel Arrangements
GoFlyAdventure has reviewed its intermediary model against Directive (EU) 2015/2302 on package travel and linked travel arrangements (the "Directive") and, where applicable, the UK Package Travel and Linked Travel Arrangements Regulations 2018. The following provisions apply worldwide to all bookings made through the platform, in addition to the OTA Intermediary Status provisions above:
- GoFlyAdventure operates as an online travel agency offering more than twenty-five (25) categories of Travel Products. Each booking made through the platform is, by default, for a single, stand-alone Travel Product selected by the User, and is not offered, sold, combined, or held out by GoFlyAdventure as a pre-arranged Package.
- Where a User selects and books only one Travel Product in a single transaction, that booking constitutes a Single Travel Service. GoFlyAdventure acts solely as an intermediary or Retailer facilitating a direct contract between the User and the Supplier, and does not act as Organizer of that Travel Product.
- Where a User selects and pays for more than one Travel Product for the same trip within a single booking transaction on the platform, such that the Travel Products are combined by GoFlyAdventure before a single contract is concluded or purchased under separate contracts from a single point of sale as part of that same transaction, the combination may constitute a Package. In such cases, GoFlyAdventure will identify the booking as a Package at the point of sale and provide the pre-contractual information, price transparency, and insolvency protection required under the Directive.
- Where a User books a Single Travel Service and the platform subsequently facilitates the User's booking of at least one additional, separate Travel Product from a different Supplier within twenty-four (24) hours of the confirmation of the first booking, the arrangement may constitute a Linked Travel Arrangement. Where an LTA is created, GoFlyAdventure will provide the User with the applicable pre-contractual LTA statement and maintain insolvency protection for monies received in connection with the LTA, in accordance with Article 19 of the Directive and equivalent applicable legislation.
- Except where a booking is expressly identified as a Package at the point of sale, GoFlyAdventure does not act, and shall not be deemed to act, as Organizer. Each Travel Product forming part of a User's trip remains an individual contract between the User and the relevant Supplier, governed by that Supplier's own terms, cancellation policy, and liability regime, without prejudice to any LTA insolvency protection disclosed under this section.
- GoFlyAdventure maintains insolvency protection arrangements, where required, sufficient to refund all payments made by Users and, where transport is included, to repatriate Users, in respect of Packages for which it acts as Organizer and Linked Travel Arrangements it facilitates, in accordance with the Directive and equivalent applicable legislation. Details of the applicable insolvency protection body are available through the platform's help center.
- For Users and bookings outside the European Union, European Economic Area, and United Kingdom, GoFlyAdventure applies the same single-service and Linked Travel Arrangement disclosure principles worldwide, with jurisdiction-specific compliance measures set out in the "Worldwide Jurisdictional Compliance" section of this Agreement.
- Nothing in this section limits or excludes any liability that cannot lawfully be limited or excluded under mandatory law, including any Organizer liability that may arise under the Directive or equivalent applicable legislation where GoFlyAdventure expressly acts, or is legally deemed to act, as Organizer of a Package.
5. Worldwide Jurisdictional Compliance
GoFlyAdventure provides its OTA services worldwide and intends to continue expanding into new markets. This section sets out jurisdiction-specific compliance measures applicable to major markets in which GoFlyAdventure currently operates or intends to operate. Where the mandatory consumer protection, travel-trade, or seller-of-travel law of a User's or Supplier's jurisdiction provides protections that differ from, or are additional to, this Agreement, that Mandatory Local Law shall prevail over this section to the extent of any conflict.
5.1 United Kingdom
For bookings made by Users in, or relating to travel from, the United Kingdom, GoFlyAdventure complies with the Package Travel and Linked Travel Arrangements Regulations 2018, the Consumer Rights Act 2015, and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Where a Package includes flights and falls within scope, GoFlyAdventure or the relevant Supplier will hold, or rely on, an ATOL, and payments for such Packages will be protected in accordance with the applicable ATOL Regulations administered by the UK Civil Aviation Authority. GoFlyAdventure also participates in, or directs Users to, a certified Alternative Dispute Resolution (ADR) provider in accordance with the Alternative Dispute Resolution for Consumer Disputes (Amendment) Regulations 2015.
5.2 United States
For bookings made by Users located in, or relating to travel within, the United States, GoFlyAdventure complies with applicable Seller of Travel Laws, including registration, disclosure, and trust-account or bonding requirements in states that impose such requirements (including California, Florida, Hawaii, Washington, and Iowa), and with the consumer protection standards of Section 5 of the Federal Trade Commission Act and applicable state unfair and deceptive trade practices statutes. Where GoFlyAdventure sends promotional calls, text messages, or communications to Users in the United States, it does so in accordance with the Telephone Consumer Protection Act (TCPA) and applicable state telemarketing laws.
5.3 Canada
For bookings made by Users located in Canada, GoFlyAdventure complies with applicable federal and provincial travel-trade and consumer protection legislation, including registration with the Travel Industry Council of Ontario (TICO) where required for Users located in Ontario, the Travel Industry Act and equivalent regulations of Quebec, British Columbia, and other provinces, and Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).
5.4 Australia and New Zealand
For bookings made by Users located in Australia or New Zealand, GoFlyAdventure complies with the Australian Consumer Law set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth), including applicable consumer guarantees, unfair contract terms provisions, and prohibitions on misleading or deceptive conduct enforced by the Australian Competition and Consumer Commission (ACCC), and with the Fair Trading Act 1986 and Consumer Guarantees Act 1993 of New Zealand, in each case to the extent applicable to GoFlyAdventure's intermediary role.
5.5 European Union (Member States Generally)
In addition to the Directive, for Users located in the European Union, GoFlyAdventure complies with the Consumer Rights Directive as implemented in the national law of each member state, the E-Commerce Directive, and, where applicable, the Digital Services Act. Users located in the European Union may refer disputes to the ODR Platform. Where a Home Member State is identified for a specific Package or Linked Travel Arrangement, the insolvency protection and pre-contractual information requirements of that Home Member State apply in addition to any host member state information requirements imposed by the Directive.
5.6 South Africa
For bookings made by Users located in South Africa, GoFlyAdventure complies with the Consumer Protection Act 2008 and its regulations administered by the National Consumer Commission, and with the Protection of Personal Information Act 2013 (POPIA) administered by the Information Regulator, including applicable registration and cross-border data transfer requirements.
5.7 Nigeria
For bookings made by Users located in Nigeria, GoFlyAdventure complies with the Federal Competition and Consumer Protection Act 2018 and its regulations administered by the Federal Competition and Consumer Protection Commission (FCCPC), and with the Nigeria Data Protection Act 2023 administered by the Nigeria Data Protection Commission.
5.8 Kenya
For bookings made by Users located in Kenya, GoFlyAdventure complies with the Consumer Protection Act 2012 and the Data Protection Act 2019 administered by the Office of the Data Protection Commissioner.
5.9 Egypt, Morocco, and Ghana
For bookings made by Users located in Egypt, Morocco, or Ghana, GoFlyAdventure complies, where applicable, with Egypt's Consumer Protection Law and Personal Data Protection Law, Morocco's Law 09-08 on the protection of individuals with regard to the processing of personal data, and Ghana's Data Protection Act 2012 and Electronic Transactions Act 2008, together with the tourism and consumer protection frameworks applicable in each of those jurisdictions.
5.10 United Arab Emirates
For bookings made by Users located in, or travel originating from, the United Arab Emirates, GoFlyAdventure complies with the Federal Consumer Protection Law (Federal Law No. 15 of 2020), the Federal Decree-Law on Electronic Transactions and Trust Services, and, where applicable, the personal data protection requirements of the UAE Federal Decree-Law No. 45 of 2021 or the applicable free zone data protection regime (including the DIFC or ADGM, where relevant).
5.11 Saudi Arabia and Qatar
For bookings made by Users located in Saudi Arabia or Qatar, GoFlyAdventure complies, where applicable, with Saudi Arabia's E-Commerce Law and Personal Data Protection Law administered by the Saudi Data and Artificial Intelligence Authority, and with Qatar's Consumer Protection Law and Personal Data Privacy Protection Law administered by the Compliance and Data Protection Department.
5.12 Singapore
For bookings made by Users located in Singapore, GoFlyAdventure complies with the Consumer Protection (Fair Trading) Act and the Personal Data Protection Act 2012 administered by the Personal Data Protection Commission.
5.13 Japan
For bookings made by Users located in Japan, GoFlyAdventure complies, where applicable, with the Act Against Unjustifiable Premiums and Misleading Representations, the Act on Specified Commercial Transactions, and the Act on the Protection of Personal Information (APPI) administered by the Personal Information Protection Commission. Where GoFlyAdventure's activities fall within the scope of Japan's Travel Agency Act, GoFlyAdventure will hold or rely on the relevant registration.
5.14 China
For bookings made by Users located in mainland China, GoFlyAdventure complies, where applicable, with the Personal Information Protection Law (PIPL), the Data Security Law, the E-Commerce Law, and applicable regulations of the Ministry of Culture and Tourism governing online travel agencies, including any requirements for local data storage, cross-border data transfer security assessment, or local representation.
5.15 India
For bookings made by Users located in India, GoFlyAdventure complies with the Consumer Protection (E-Commerce) Rules 2020 and, once in force, the Digital Personal Data Protection Act 2023, and with applicable Reserve Bank of India payment aggregation and cross-border remittance regulations to the extent GoFlyAdventure or its Payment Processor processes payments for Users in India.
5.16 South Korea and Hong Kong
For bookings made by Users located in South Korea, GoFlyAdventure complies, where applicable, with the Act on Promotion of Information and Communications Network Utilization and Information Protection and the Personal Information Protection Act (PIPA) administered by the Personal Information Protection Commission. For bookings made by Users located in Hong Kong, GoFlyAdventure complies with the Personal Data (Privacy) Ordinance administered by the Office of the Privacy Commissioner for Personal Data, and, where applicable, the Travel Industry Authority's licensing requirements for travel agents.
5.17 Brazil
For bookings made by Users located in Brazil, GoFlyAdventure complies with the Código de Defesa do Consumidor (Consumer Defense Code), the Lei Geral de Proteção de Dados (LGPD) administered by the Autoridade Nacional de Proteção de Dados (ANPD), and applicable registration requirements of the Ministry of Tourism and EMBRATUR for travel intermediaries, where such requirements apply to GoFlyAdventure's activities.
5.18 Mexico, Argentina, and Colombia
For bookings made by Users located in Mexico, Argentina, or Colombia, GoFlyAdventure complies, where applicable, with Mexico's Federal Consumer Protection Law and Federal Law on Protection of Personal Data Held by Private Parties, Argentina's Consumer Protection Law 24,240 and Personal Data Protection Law 25,326, and Colombia's Consumer Protection Statute (Law 1480 of 2011) and Law 1581 of 2012 on data protection administered by the Superintendencia de Industria y Comercio.
5.19 Caribbean Jurisdictions
For bookings made by Users located in Caribbean jurisdictions, GoFlyAdventure complies, where applicable, with the consumer protection, data protection, and tourism-sector legislation of the relevant jurisdiction, including Jamaica's Consumer Protection Act and Data Protection Act 2020, and equivalent legislation in other Caribbean states in which GoFlyAdventure operates or provides its services.
5.20 Cross-Border Payments and Currency Conversion
Where a User makes a Cross-Border Payment, currency conversion is performed by the Payment Processor or the User's card issuer, and GoFlyAdventure does not guarantee any particular exchange rate. GoFlyAdventure and its Payment Processors comply with applicable payment services, e-money, and cross-border remittance regulations in the jurisdictions in which payments are processed, including, where applicable, the revised Payment Services Directive (PSD2) in the European Union and equivalent payment services regulation in other jurisdictions.
5.21 Taxation, VAT, and GST
Prices displayed on the platform include applicable VAT unless otherwise stated, calculated by reference to the User's location, the Supplier's location, or the place of supply, as required under the tax legislation of the relevant jurisdiction. GoFlyAdventure, the Merchant of Record, or the Supplier, as applicable, is responsible for accounting for VAT to the competent tax authority in accordance with applicable law, including the European Union's VAT e-commerce rules, the destination-based sales tax regimes of United States jurisdictions, and equivalent GST or consumption tax regimes elsewhere.
5.22 Sanctions, Export Control, and Anti-Money Laundering
GoFlyAdventure does not knowingly provide services to, or process payments on behalf of, any individual or entity that is the subject of applicable Sanctions Laws, or that is located in a jurisdiction subject to comprehensive sanctions. GoFlyAdventure and its Payment Processors apply KYC and AML Laws-compliant verification measures proportionate to the risk presented by a User, Supplier, or transaction.
5.23 International Data Transfers
Where GoFlyAdventure transfers Personal Data from the European Economic Area, United Kingdom, or another jurisdiction with restrictions on cross-border data transfer to a jurisdiction that has not received an Adequacy Decision, GoFlyAdventure relies on Standard Contractual Clauses or another valid transfer mechanism recognized under applicable data protection legislation, as further described in the Privacy Policy.
5.24 Other Jurisdictions
For Users and Suppliers in any jurisdiction not expressly named in this section, GoFlyAdventure applies the same disclosure, transparency, and consumer protection principles set out in this Agreement, and complies with the equivalent package travel, travel agent, seller-of-travel, electronic commerce, or consumer protection framework of that jurisdiction, to the extent applicable and required by Mandatory Local Law, as GoFlyAdventure expands its operations into new markets.
5.25 Precedence of Mandatory Local Law
Nothing in this Agreement limits or excludes any right, remedy, or protection that cannot lawfully be limited or excluded under the Mandatory Local Law of a User's or Supplier's jurisdiction. Where any provision of this Agreement conflicts with Mandatory Local Law, that provision shall be interpreted, to the minimum extent necessary, to comply with such Mandatory Local Law in that jurisdiction, without affecting the validity of the remaining provisions of this Agreement or its application in other jurisdictions.
5.26 No Jurisdiction-Specific License Implied
The disclosures in this section describe GoFlyAdventure's general worldwide compliance approach and do not constitute a representation that GoFlyAdventure holds every license, registration, bond, or authorization in every jurisdiction referenced. Users and Suppliers should refer to the platform's help center for jurisdiction-specific licensing, registration, and insolvency protection information applicable to a particular booking.
6. Albania — Home Jurisdiction Compliance
GoFlyAdventure LLC is registered in the Republic of Albania, with its registered address at Kompleksi "Turquoise Marina" - M13-3/33, Hamallaj, Albania. As GoFlyAdventure's home jurisdiction, Albania's corporate, commercial, consumer protection, and licensing law applies to GoFlyAdventure's operation of the platform in addition to the protections available to Users under their own local Mandatory Local Law:
- GoFlyAdventure LLC is registered with the National Business Center (Qendra Kombëtare e Biznesit, "QKB") under Law No. 131/2015 "On the National Business Center," as amended, and maintains its unique identification number (NIPT) and corporate filings in good standing with the QKB.
- GoFlyAdventure complies with Law No. 9902, dated 17 April 2008, "On Consumer Protection," as amended, and its implementing regulations, including applicable provisions on unfair commercial practices, pre-contractual information, and distance contracts, as supervised by the State Inspectorate for Market Surveillance and the ministry responsible for consumer protection.
- GoFlyAdventure complies with Law No. 9918, dated 19 May 2008, "On Electronic Commerce," as amended, governing information society services, distance contracts, and the liability regime applicable to intermediary service providers established in Albania.
- GoFlyAdventure complies with Law No. 9887, dated 10 March 2008, "On the Protection of Personal Data," as amended to align with the standards of the GDPR, and is subject to the supervision of the Information and Data Protection Commissioner (IDP) of the Republic of Albania.
- Where GoFlyAdventure's activities constitute the organizing or retailing of tourism packages within the meaning of Albanian law, GoFlyAdventure complies with Law No. 93/2015 "On Tourism," as amended, including applicable licensing of tour operators and travel agencies administered by the National Tourism Agency (Agjencia Kombëtare e Turizmit, "AKT") and the ministry responsible for tourism.
- GoFlyAdventure complies with Albanian tax legislation applicable to its operations, including Law No. 92/2014 "On Value Added Tax in the Republic of Albania," as amended, and Law No. 8438 "On Income Tax," as amended, as administered by the General Directorate of Taxation.
- GoFlyAdventure complies with Law No. 9917, dated 19 May 2008, "On the Prevention of Money Laundering and Terrorist Financing," as amended, including applicable customer due diligence and reporting obligations relevant to its role as an intermediary processing Bookings and payments.
- Albania is a candidate country for accession to the European Union. GoFlyAdventure monitors the progressive alignment of Albanian legislation with the European Union acquis, including the future domestic implementation of the Directive, the Digital Services Act, and other European Union instruments referenced in this Agreement, and will update its compliance measures as such alignment takes effect.
- Without prejudice to any right, remedy, or protection available to a User under the Mandatory Local Law of the User's own jurisdiction, this Agreement is additionally governed by the laws of the Republic of Albania in respect of GoFlyAdventure's corporate existence, licensing, and operation as an Albanian legal entity, and the courts of Albania shall have non-exclusive jurisdiction over any dispute relating to that corporate existence, licensing, or operation.
- Where GoFlyAdventure or its Payment Processor provides payment services to Users in Albania, such services are provided in compliance with Law No. 55/2014 "On Payment Services in the Republic of Albania," as amended, and applicable regulations and licensing requirements of the Bank of Albania.
- Albanian Consumers may pursue amicable dispute resolution through mediation in accordance with Law No. 10385, dated 24 June 2011, "On Mediation in Dispute Resolution," as amended, or may refer complaints to the competent Albanian consumer protection authority, in each case in addition to the dispute resolution avenues described in the "Dispute Resolution" section of this Agreement.
7. Eligibility
- You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use the platform or make a booking.
- You must have the legal capacity to enter into binding contracts under the laws of your jurisdiction.
- If you are using the platform on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to this Agreement.
- You agree to provide accurate, current, and complete information during registration and throughout your use of the platform, and to update such information promptly when it changes.
8. Account Registration
- Certain features of the platform require account registration. You agree to provide truthful, accurate, and complete registration information.
- You are solely responsible for maintaining the confidentiality and security of your account credentials, including your password. You must not share your login credentials with any third party.
- GoFlyAdventure may require identity verification, including government-issued identification documents, for security, fraud prevention, or regulatory compliance purposes.
- The Company may conduct Know Your Customer (KYC) verification for Users and Suppliers as required by applicable anti-money laundering and counter-terrorism financing regulations.
- You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized access or use of your account.
- The Company reserves the right to suspend, restrict, or terminate any account at its sole discretion, including for violations of this Agreement, suspected fraud, or security concerns, with or without prior notice.
9. Booking Process
- The platform provides search, comparison, and booking functionality for travel products and services offered by Suppliers. Search results are based on availability, pricing, relevance, and other factors.
- A booking request submitted through the platform constitutes an offer to the Supplier. The booking is not confirmed until the Supplier accepts the reservation and a booking confirmation is issued.
- Booking confirmations are sent electronically to the email address associated with the User's account. The booking confirmation constitutes the contractual record of the reservation.
- Prices displayed on the platform are dynamic and may change based on demand, availability, currency fluctuations, Supplier pricing changes, and other market factors. Prices are not guaranteed until a booking is confirmed.
- Inventory and availability are subject to change without notice. The platform displays availability as reported by Suppliers and does not guarantee real-time accuracy.
- Suppliers may accept or decline booking requests at their discretion, subject to their own terms and conditions.
- Reservations are valid for the dates, times, and terms specified in the booking confirmation. Any changes are subject to the modification and cancellation policies applicable to the booking.
- Unless expressly identified as a Package at checkout, each booking made through the platform is for a single, stand-alone Travel Product selected by the User. Where a User selects more than one Travel Product for the same trip within a single booking transaction, or books an additional Travel Product within twenty-four (24) hours of an earlier booking, the arrangement may constitute a Package or a Linked Travel Arrangement, in which case the disclosures and protections set out in the "EU Package Travel Directive and Linked Travel Arrangements" section shall apply.
10. Pricing, Taxes, Fees, and Currency
- All prices displayed on the platform are inclusive of applicable taxes unless otherwise stated. Additional local taxes, resort fees, city taxes, or government-imposed levies may apply and will be disclosed where known.
- The platform may charge service fees, convenience fees, booking fees, or transaction fees in connection with bookings. Such fees will be clearly disclosed before the User completes the booking.
- Suppliers may impose additional charges, including but not limited to resort fees, cleaning fees, energy surcharges, parking fees, and other mandatory or optional charges. These will be disclosed to the extent provided by the Supplier.
- Prices displayed on the platform may be shown in a currency selected by the User or determined by the User's location. Currency conversion rates are indicative and may differ from rates applied by the User's bank or payment provider.
- Exchange rates are provided for convenience only and are not guaranteed. The actual amount charged may vary due to exchange rate fluctuations between the time of booking and the time of payment settlement.
- Price display is subject to rounding, formatting limitations, and real-time availability. The final price confirmed at checkout is the binding price for the transaction.
11. Payments
- Payments for bookings made through the platform are processed by third-party payment processors. By making a payment, you agree to the payment processor's terms and conditions.
- The Company may act as the Merchant of Record for certain transactions, meaning it processes the payment on behalf of the Supplier. In such cases, the Company facilitates the transaction but remains an intermediary.
- Card authorization and verification may be performed at the time of booking. Your payment method may be pre-authorized or charged at the time of booking or at a later date, depending on the Supplier's and platform's payment policies.
- The Company is not liable for unauthorized transactions, card fraud, or payment disputes that arise from third-party payment processing. You are responsible for monitoring your payment statements.
- Chargebacks initiated without first attempting to resolve the issue through the platform's customer support may result in account suspension or termination.
- Fraud screening and risk assessment may be performed on all transactions. The Company reserves the right to decline, delay, or cancel bookings where fraud or payment risk is suspected.
- Payment settlement to Suppliers may be subject to processing delays, verification requirements, and applicable settlement schedules.
12. Refunds
- Refund eligibility is determined by the cancellation and refund policy applicable to each booking, as set by the Supplier and disclosed at the time of booking.
- Refunds, where applicable, shall be initiated without undue delay through the original payment method, subject to the applicable cancellation policy, the operational requirements of the relevant payment service provider, and applicable law. The time required for the refunded funds to appear in the customer's account may vary depending on the payment method, payment service provider, banking systems, card network rules, regulatory requirements, and the customer's financial institution.
- Refunds are generally issued to the original payment method. Alternative refund methods (such as platform credit) may be offered at the Company's discretion.
- Supplier-controlled refunds are subject to the Supplier's refund policies. The Company facilitates refund requests but does not guarantee Supplier approval.
- GoFlyAdventure may retain administrative or processing fees in connection with refund processing, where permitted by applicable law and disclosed at the time of booking.
- Non-refundable bookings, as designated by the Supplier, are not eligible for refunds except where required by mandatory applicable law.
13. Cancellation Policy
- Customer cancellations are subject to the cancellation policy applicable to the specific booking, as disclosed at the time of reservation. Cancellation fees, penalties, and deadlines vary by Supplier and booking type.
- Suppliers may cancel bookings due to force majeure, overbooking, regulatory requirements, safety concerns, or other circumstances. In such cases, the Supplier is responsible for offering alternative arrangements or refunds.
- GoFlyAdventure reserves the right to cancel bookings in cases of suspected fraud, payment failure, violations of this Agreement, or operational necessity. Users will be notified and refunds will be processed where applicable.
- No-show policies are determined by the Supplier. Failure to arrive at the booked accommodation or service without prior cancellation may result in forfeiture of the full booking amount.
- Partial cancellations (such as cancelling one night of a multi-night stay) may be permitted at the Supplier's discretion and are subject to the applicable cancellation terms.
- Emergency cancellations due to extraordinary circumstances (such as natural disasters, medical emergencies, or government-imposed travel restrictions) may be handled on a case-by-case basis in accordance with applicable law and Company policies.
14. Booking Modifications
- Booking changes, including date changes, name changes, room upgrades, and service modifications, are subject to Supplier availability and approval.
- Rescheduling requests are processed on a best-effort basis and may be subject to availability limitations, price differences, and applicable modification fees.
- Modifications may result in price changes, including increases or decreases, based on the rates applicable at the time of modification.
- Additional fees may apply for booking modifications, as determined by the Supplier and disclosed during the modification process.
15. Travel Requirements
Users are solely responsible for ensuring compliance with all travel requirements applicable to their itinerary:
- Valid passport with sufficient remaining validity as required by the destination country.
- Visas, entry permits, transit visas, and electronic travel authorizations required by destination and transit countries.
- Vaccinations, health certificates, and other health documentation as required by destination and transit countries.
- Compliance with customs regulations, import/export restrictions, and declaration requirements.
- Compliance with immigration requirements, including proof of return travel, sufficient funds, and accommodation arrangements.
- GoFlyAdventure does not verify, guarantee, or take responsibility for Users' compliance with travel entry requirements. Travel requirements may change without notice, and Users are advised to consult official government sources before travel.
16. Insurance Disclaimer
GoFlyAdventure strongly recommends that all Users obtain comprehensive travel insurance before embarking on any trip. The Company does not provide, arrange, or guarantee any insurance coverage:
- Travel insurance covering trip cancellation, interruption, delay, and curtailment.
- Medical insurance covering illness, injury, hospitalization, and medical evacuation during travel.
- Coverage for lost, stolen, or damaged baggage and personal belongings.
- Emergency evacuation and repatriation coverage.
- GoFlyAdventure is not liable for any losses, costs, or expenses arising from the User's failure to obtain adequate travel or medical insurance.
17. Supplier Responsibilities
- Suppliers are solely responsible for the accuracy, completeness, and truthfulness of all listing information, descriptions, photographs, prices, availability, and terms published on the platform.
- Suppliers must maintain all required business licenses, permits, registrations, insurance, and regulatory authorizations necessary to operate their travel services legally in their jurisdiction.
- Suppliers must comply with all applicable local, national, and international laws and regulations, including consumer protection, health and safety, anti-discrimination, accessibility, data protection, and tax regulations.
- Suppliers must fulfill their obligations to Users as described in the booking confirmation, including providing the agreed-upon services, accommodations, or products.
- Suppliers are responsible for the safety and well-being of guests and travelers during the provision of their services, including compliance with fire safety, hygiene, and building code requirements.
18. User Responsibilities
- Users must use the platform for lawful purposes only and in compliance with this Agreement, all applicable laws, and the rules and policies of Suppliers.
- Users must comply with Supplier rules, house rules, check-in/check-out times, property policies, and any terms communicated during the booking process.
- Users must provide accurate personal information, contact details, and booking details. False or misleading information may result in booking cancellation and account termination.
- Users must conduct themselves respectfully toward Supplier staff, other guests, and the property or service environment. Disruptive, dangerous, or unlawful behavior may result in immediate removal without refund.
19. Prohibited Activities
Users and Suppliers must not engage in any of the following activities:
- Fraud, including making bookings with stolen, counterfeit, or unauthorized payment methods.
- Chargeback abuse, including initiating chargebacks without first attempting resolution through the platform's dispute process.
- Identity theft, impersonation, or misrepresentation of identity or authority.
- Unauthorized scraping, crawling, harvesting, or automated extraction of data or content from the platform.
- Use of bots, scripts, spiders, or automated tools to access, interact with, or extract information from the platform without prior written authorization.
- Data mining, reverse engineering, decompiling, disassembling, or attempting to derive the source code, algorithms, or architecture of the platform.
- Infringement of intellectual property rights, including unauthorized reproduction, distribution, or use of platform content, trademarks, or copyrighted materials.
- Introduction of malware, viruses, ransomware, trojans, worms, or any harmful code into the platform.
- Posting fake reviews, manipulating ratings, or engaging in review fraud.
- Money laundering, terrorist financing, sanctions evasion, or any activity in violation of anti-money laundering (AML) or counter-terrorism financing (CTF) laws.
20. Reviews and User Content
- Users retain ownership of User Content they submit to the platform. By submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, display, and create derivative works from such content in connection with the platform and its services.
- The Company reserves the right to moderate, edit, remove, or refuse to publish any User Content that violates this Agreement, applicable law, community standards, or platform policies.
- The Company may remove User Content at its sole discretion, including content that is defamatory, obscene, fraudulent, misleading, discriminatory, harassing, or otherwise objectionable.
- Users must not submit content that is defamatory, libelous, fraudulent, or that infringes on the rights of third parties. Users are solely responsible for the accuracy and legality of their User Content.
21. Intellectual Property
All intellectual property rights in and to the GoFlyAdventure platform, including but not limited to the following, are owned by or licensed to the Company:
- Trademarks, service marks, trade names, logos, and brand identities.
- Copyrights in all original content, designs, layouts, user interfaces, and creative works.
- Database rights in compiled data, listing databases, user databases, and analytics.
- Software, source code, object code, algorithms, APIs, and technical architecture.
- Trade secrets, proprietary processes, business methods, and confidential information.
- No license, right, or interest in any Company intellectual property is granted except as expressly stated in this Agreement.
22. Third-Party Links and Services
- The platform may contain links to third-party websites, applications, and services. These links are provided for convenience only and do not constitute an endorsement, sponsorship, or recommendation.
- Third-party integrations, including payment processors, mapping services, and analytics providers, are governed by their own terms of service and privacy policies.
- GoFlyAdventure is not responsible for the content, accuracy, availability, privacy practices, or security of third-party websites or services.
23. Data Protection and Privacy
GoFlyAdventure is committed to protecting the personal data and privacy of its Users in accordance with applicable data protection legislation:
- The processing of personal data shall be governed by all applicable data protection, privacy, cybersecurity, and electronic communications laws and regulations, including, where applicable, the laws of the Republic of Albania, the General Data Protection Regulation (EU) 2016/679 (GDPR), the UK General Data Protection Regulation (UK GDPR), the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), Australia's Privacy Act 1988, Singapore's Personal Data Protection Act (PDPA), Japan's Act on the Protection of Personal Information (APPI), Brazil's General Data Protection Law (LGPD), the Swiss Federal Act on Data Protection (FADP), and any other applicable national, regional, supranational, or international data protection, privacy, cybersecurity, and electronic communications laws and regulations in the jurisdictions where the Company operates or provides its services.
- Cross-border transfers of personal data are conducted in compliance with approved legal mechanisms, including Standard Contractual Clauses (SCCs), adequacy decisions, and other transfer safeguards.
- Users have rights regarding their personal data, including the right of access, rectification, erasure ("right to be forgotten"), data portability, restriction of processing, and the right to object to processing.
- Personal data is retained only for as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce agreements.
- The Company implements appropriate technical and organizational security measures to protect personal data against unauthorized access, alteration, disclosure, or destruction.

- Users located in Albania may direct data protection inquiries or complaints to the Information and Data Protection Commissioner (IDP), in addition to, and without prejudice to, any right to contact GoFlyAdventure's Data Protection Officer directly.
24. Communications
- By using the platform, you consent to receive electronic communications from the Company, including booking confirmations, account notifications, service updates, and legal notices via email.
- The Company may send SMS or push notifications for booking updates, security alerts, and time-sensitive communications, subject to your device settings and preferences.
- All notices and communications provided electronically constitute valid notice under this Agreement and satisfy any legal requirement that such notices be in writing.
- Marketing communications, including promotional offers, newsletters, and personalized recommendations, will only be sent with your consent where required by applicable law. You may opt out of marketing communications at any time.
25. Force Majeure
Neither the Company, Users, nor Suppliers shall be liable for any failure or delay in performance resulting from Force Majeure events, including but not limited to:
- Pandemics, epidemics, public health emergencies, quarantines, and government-imposed travel restrictions.
- Natural disasters, including earthquakes, floods, hurricanes, volcanic eruptions, tsunamis, and severe weather events.
- Government actions, including embargoes, sanctions, border closures, travel bans, and regulatory changes.
- Civil unrest, riots, protests, strikes, and labor disputes.
- Armed conflict, war, terrorism, insurrection, and military operations.
- Cyberattacks, data breaches, denial-of-service attacks, and technology infrastructure failures.
- Transportation disruptions, including airline cancellations, airport closures, port closures, road closures, and fuel shortages.
26. Disclaimers
- THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
- THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
- THE COMPANY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
- THE COMPANY DOES NOT WARRANT THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY CONTENT, LISTING INFORMATION, PRICING, AVAILABILITY, OR SUPPLIER-PROVIDED INFORMATION DISPLAYED ON THE PLATFORM.
- THE COMPANY DISCLAIMS ALL LIABILITY FOR THE ACTS, OMISSIONS, ERRORS, REPRESENTATIONS, WARRANTIES, BREACHES, OR NEGLIGENCE OF ANY SUPPLIER, OR FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING THEREFROM.
27. Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.
- This limitation includes, without limitation, damages for lost profits, lost revenue, lost data, loss of goodwill, business interruption, personal injury (to the extent permitted by law), travel disruptions, Supplier misconduct, and any other intangible losses.
- IN NO EVENT SHALL THE COMPANY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE USE OF THE PLATFORM EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (€100).
- The limitations and exclusions in this section apply to the fullest extent permitted by applicable law, regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if the Company has been advised of the possibility of such damages.
- Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable mandatory law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
28. Indemnification
- You agree to indemnify, defend, and hold harmless the Company, its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the platform; (b) your violation of this Agreement; (c) your violation of any applicable law or regulation; (d) your User Content; or (e) any dispute between you and a Supplier.
- Suppliers agree to indemnify, defend, and hold harmless the Company from and against any claims arising from: (a) the Supplier's provision of travel services; (b) inaccurate, misleading, or incomplete listing information; (c) violation of applicable laws or regulations; or (d) any dispute between the Supplier and a User.
29. Legal and Regulatory Compliance
- The Company is committed to compliance with applicable anti-money laundering (AML) regulations and may conduct transaction monitoring, suspicious activity reporting, and enhanced due diligence.
- Know Your Customer (KYC) verification may be required for Users and Suppliers in accordance with applicable financial regulations.
- The Company complies with all applicable anti-bribery, anti-corruption, anti-fraud, anti-money laundering, and sanctions laws and regulations, including, where applicable, the laws of the Republic of Albania, the anti-corruption and anti-money laundering legislation of the European Union, the UK Bribery Act 2010, the UK Criminal Finances Act 2017, the United States Foreign Corrupt Practices Act (FCPA), and any other applicable national, regional, supranational, or international anti-bribery, anti-corruption, anti-fraud, anti-money laundering, sanctions, and ethics laws and regulations in the jurisdictions where the Company operates or provides its services.
- The Company complies with applicable international sanctions programs and export control regulations. Transactions with sanctioned persons, entities, or jurisdictions are prohibited.
- Users and Suppliers must comply with all applicable consumer protection laws in their respective jurisdictions.
30. Dispute Resolution
- Any dispute, claim, or controversy arising out of or relating to this Agreement or the use of the platform shall first be submitted to the Company's internal complaint-handling procedures via the platform's help center or customer support channels.
- If the dispute is not resolved through internal procedures within thirty (30) days, either party may submit the dispute to mediation administered by a mutually agreed mediator.
- If mediation is unsuccessful, the dispute shall be finally resolved by binding arbitration seated in Tirana, Republic of Albania, in accordance with the applicable arbitration laws of the Republic of Albania and the arbitration rules of the arbitral institution agreed upon by the Parties or, in the absence of such agreement, by the arbitral institution designated in accordance with the applicable laws of the Republic of Albania. The language of the arbitration shall be English, unless the Parties agree otherwise in writing.
- This Agreement shall be governed by and construed in accordance with the laws of Albania, without regard to its conflict of law provisions.
- The exclusive venue for any litigation arising out of this Agreement shall be the courts located in Albania.
- All proceedings shall be conducted in the English language, unless otherwise required by applicable law.
31. Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST THE COMPANY. If this action waiver is found to be unenforceable in any jurisdiction, the entirety of this arbitration provision shall be deemed void with respect to that jurisdiction.
32. Termination
- Users may terminate their account at any time by contacting customer support or using the account deletion feature on the platform. Termination does not relieve Users of obligations for existing bookings.
- Suppliers may terminate their relationship with the platform in accordance with their Supplier agreement. Active bookings must be honored regardless of termination.
- The Company reserves the right to immediately suspend, restrict, or terminate any User or Supplier account at its sole discretion, without prior notice, for violations of this Agreement, suspected fraud, illegal activity, safety concerns, or any other reason the Company deems appropriate.
33. Survival of Clauses
The following provisions shall survive the termination or expiration of this Agreement: Definitions, OTA Intermediary Status, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, Class Action Waiver, Data Protection, Compliance, Confidentiality, and any other provisions which by their nature are intended to survive termination.
34. Assignment
The Company may assign, transfer, or delegate its rights and obligations under this Agreement to any affiliate, successor, or acquirer without your consent. You may not assign, transfer, or delegate your rights or obligations under this Agreement without the prior written consent of the Company. Any purported assignment in violation of this section is void.
35. Severability
If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
36. Entire Agreement
This Agreement, together with the Privacy Policy, Cookie Policy, Supplier Terms, and any other policies incorporated by reference, constitutes the entire agreement between you and GoFlyAdventure LLC regarding your use of the platform. This Agreement supersedes all prior and contemporaneous agreements, representations, warranties, and understandings, whether written, oral, or implied.

38. Regulatory Disclosures
- GoFlyAdventure operates as an intermediary platform and is not a regulated travel organizer, insurer, financial institution, or licensed tour operator unless expressly stated otherwise for specific jurisdictions.
- Where required by local law, the Company maintains applicable registrations, licenses, or authorizations for the operation of an online travel agency or digital marketplace.
- The Company shall comply with all applicable laws and regulations governing digital platforms, online intermediaries, electronic commerce, consumer protection, and online marketplace services, including, where applicable, the laws of the Republic of Albania, the legislation of the European Union (including Regulation (EU) 2022/2065 – the Digital Services Act), the laws of the United Kingdom, the United States of America, Canada, Australia, New Zealand, Singapore, Japan, the United Arab Emirates, Switzerland, and any other applicable national, regional, supranational, or international laws and regulations relating to platform transparency, trader verification, content moderation, consumer information, online safety, and digital intermediary services.
- The Company's complaint-handling procedures, out-of-court dispute resolution mechanisms, and contact points are available through the platform's help center.
- Where applicable, GoFlyAdventure complies with Directive (EU) 2015/2302 on package travel and linked travel arrangements and, where applicable, the UK Package Travel and Linked Travel Arrangements Regulations 2018, as further described in the "EU Package Travel Directive and Linked Travel Arrangements" section of this Agreement.
- GoFlyAdventure additionally complies, where applicable, with the jurisdiction-specific compliance measures set out in the "Worldwide Jurisdictional Compliance" section of this Agreement, covering, among others, the United Kingdom, United States, Canada, Australia, New Zealand, African jurisdictions, Asia-Pacific, the Middle East, and Latin America.
39. Digital Marketplace Disclosures
- GoFlyAdventure is a digital marketplace that connects Users with third-party Suppliers. The Company does not own, control, or provide the travel services listed on the platform.
- Suppliers listed on the platform may be businesses (traders) or private individuals (non-traders). The Company aims to clearly identify the status of each Supplier where required by applicable law.
- Consumer protection rights may differ depending on whether the Supplier is a trader or a non-trader. Users are encouraged to review Supplier information before making a booking.
- The ranking of search results is determined by algorithms that consider factors including relevance, price, availability, ratings, booking history, and Supplier quality signals. Sponsored or promoted results are clearly labelled.
40. Platform Governance
- The Company maintains internal policies and procedures for content moderation, Supplier verification, fraud prevention, consumer protection, and dispute resolution.
- Where required by applicable law, the Company shall prepare and publish transparency reports relating to its digital platform operations, including information on content moderation, complaint handling, enforcement actions, account restrictions, content removal, trader verification, and other matters required under applicable laws and regulations. Such reporting shall comply, where applicable, with the laws of the Republic of Albania, the legislation of the European Union (including Regulation (EU) 2022/2065 – the Digital Services Act), and any other applicable national, regional, supranational, or international laws governing digital platforms, online intermediaries, consumer protection, and electronic commerce.
- Users and Suppliers may report illegal content, policy violations, or safety concerns through the platform's reporting mechanisms. Reports are reviewed and acted upon in accordance with applicable law and platform policies.
- The Company reserves the right to take enforcement actions, including warnings, content removal, listing suspension, account restriction, and permanent termination, against Users or Suppliers who violate this Agreement or applicable law.
41. Trust and Safety Policy
- GoFlyAdventure is committed to maintaining a safe, trustworthy, and reliable marketplace for all Users and Suppliers.
- The Company employs automated and manual review processes to detect and prevent fraudulent listings, fake reviews, payment fraud, and other abusive activities.
- Users and Suppliers are encouraged to report suspicious activity, unsafe conditions, fraud, discrimination, harassment, or any safety concerns through the platform's trust and safety reporting channels.
- The Company cooperates with law enforcement and regulatory authorities in the investigation of illegal activity, fraud, and public safety threats, subject to applicable legal requirements and data protection obligations.
- The Company maintains emergency contact procedures for critical safety incidents and works with local authorities and Suppliers to respond to emergencies affecting Users.
42. Cybersecurity Provisions
- The Company implements industry-standard security measures to protect the platform, user data, and payment information, including encryption, access controls, network security, and regular security assessments.
- Users are responsible for maintaining the security of their account credentials, devices, and network connections when accessing the platform.
- The Company maintains incident response procedures for security breaches, data breaches, and cyberattacks, including notification procedures in compliance with GDPR and other applicable data breach notification requirements.
- Users must not attempt to probe, scan, test, or exploit vulnerabilities in the platform's security infrastructure without prior written authorization from the Company.
- The Company may suspend access to the platform during security incidents, maintenance windows, or when necessary to protect the integrity and security of the platform and its users.
44. Accessibility
GoFlyAdventure is committed to making the platform usable by the widest possible range of Users, including Users with disabilities.
- GoFlyAdventure aims to design and maintain the platform's booking functionality in substantial conformance with the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, or a successor standard, to the extent reasonably practicable.
- Users who have trouble accessing or using any part of the platform, or who wish to request an accommodation, may contact GoFlyAdventure through the platform's help center.
- GoFlyAdventure will use reasonable efforts to remediate reported accessibility barriers within a reasonable time, taking into account the nature of the barrier and the resources reasonably available to GoFlyAdventure.
- This section describes GoFlyAdventure's general accessibility commitment and does not itself create any right or remedy beyond those available under applicable law in the User's jurisdiction.
45. Copyright Infringement Notices
GoFlyAdventure respects the intellectual property rights of others and expects Users to do the same. This section describes the process for reporting alleged copyright infringement in Content appearing on the platform.
- A rights holder who believes that Content on the platform infringes their copyright may submit a written notice to GoFlyAdventure's designated copyright agent, identified through the platform's help center, containing: (a) identification of the copyrighted work claimed to have been infringed; (b) identification of the allegedly infringing material and its location on the platform; (c) the complainant's contact information; (d) a statement of good-faith belief that the use is not authorized; (e) a statement, under penalty of perjury where applicable, that the notice is accurate and that the complainant is authorized to act on behalf of the rights holder; and (f) a physical or electronic signature.
- Upon receipt of a valid notice, GoFlyAdventure may remove or disable access to the allegedly infringing material and will make reasonable efforts to notify the User who posted it.
- A User whose Content is removed may submit a counter-notice contesting the removal, containing substantially equivalent identifying information and a statement of good-faith belief that the material was removed as a result of mistake or misidentification.
- GoFlyAdventure reserves the right to terminate the accounts of Users who are determined, in GoFlyAdventure's reasonable discretion, to be repeat infringers.
- Nothing in this section limits GoFlyAdventure's right to remove Content for any other reason permitted under this Agreement.
46. Automated Access, Bots, and API Use
- Users must not use any robot, spider, scraper, or other automated means to access the platform, extract Content, or make bookings, except through an interface expressly authorized in writing by GoFlyAdventure or under a separate API agreement.
- Automated access authorized under a separate API agreement is subject to the terms of that agreement in addition to this Agreement, including any applicable rate limits, authentication requirements, and restrictions on use of extracted data.
- GoFlyAdventure reserves the right to monitor, rate-limit, block, or terminate any automated access that it reasonably believes degrades platform performance, circumvents security controls, or violates this Agreement.
- Users must comply with the platform's robots.txt file and any other technical measures GoFlyAdventure uses to control automated access.
48. Marketing Communications and Opt-Out
- By providing contact information, Users may receive transactional communication relating to a Booking, including confirmations, itinerary changes, and safety or logistics updates, which are not subject to opt-out while the User maintains an active Booking.
- Users may separately opt in to receive promotional communications by email, SMS, or push notification, and may withdraw that consent at any time using the unsubscribe mechanism included in each communication or through their account settings.
- GoFlyAdventure sends promotional communications in accordance with applicable marketing and electronic communications laws, including the U.S. CAN-SPAM Act, Canada's Anti-Spam Legislation (CASL), the EU ePrivacy Directive as implemented in national law, and the UK Privacy and Electronic Communications Regulations (PECR).
- Opting out of promotional communications does not affect GoFlyAdventure's ability to send transactional or legally required communications.
49. Fraud Prevention and Risk Management
- GoFlyAdventure and its Payment Processors employ automated and manual fraud detection measures to protect Users, Suppliers, and the platform from fraudulent transactions.
- GoFlyAdventure may delay, decline, cancel, or reverse a Booking, and may request additional identity or payment verification, where a transaction is flagged as high-risk or potentially fraudulent.
- GoFlyAdventure may hold funds, restrict account functionality, or suspend an account pending the outcome of a fraud investigation, and will make reasonable efforts to notify the affected User.
- Users must not use stolen, unauthorized, or fraudulently obtained payment methods, and must not attempt to circumvent the platform's fraud prevention measures.
- GoFlyAdventure may report suspected fraudulent activity to Payment Processors, law enforcement, or other competent authorities, as required or permitted by applicable law.
50. Export Control and Sanctions Compliance
- Users represent that they are not the subject of, and are not located, organized, or resident in a country or territory subject to, comprehensive sanctions administered by the United Nations Security Council, the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), the European Union, the United Kingdom, or other applicable authority, and that they are not listed on any applicable restricted-party or denied-persons list.
- The platform, including any associated software, may be subject to export control laws, including the U.S. Export Administration Regulations, and Users must not access or use the platform in violation of such laws.
- GoFlyAdventure reserves the right to restrict, suspend, or terminate access to the platform for any User or transaction where necessary to comply with applicable Sanctions Laws or export control laws.
51. Electronic Signatures and Contract Formation
- This Agreement, and any Booking confirmation, may be executed and accepted electronically, and such electronic acceptance has the same legal effect as a handwritten signature, to the extent recognized under applicable law, including the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act), the Uniform Electronic Transactions Act (UETA), Regulation (EU) No 910/2014 (eIDAS), and the UNCITRAL Model Law on Electronic Commerce.
- A User's act of clicking "I agree," "book now," or a substantially similar affirmative action constitutes the User's electronic signature and acceptance of the terms presented at that point in the booking process.
- GoFlyAdventure may rely on the electronic acceptance associated with a user's account as conclusive evidence of that User's agreement to the relevant terms, absent evidence of unauthorized account access.
52. Relationship of the Parties
- Nothing in this Agreement creates a partnership, joint venture, employment relationship, or general agency relationship between GoFlyAdventure and a User or a Supplier.
- Except for GoFlyAdventure's limited role in facilitating and processing a Booking on behalf of a Supplier as described in this Agreement, neither a User nor a Supplier has any authority to bind GoFlyAdventure, and GoFlyAdventure has no authority to bind a User or a Supplier beyond confirming a Booking in accordance with its terms.
- Each Supplier is an independent business responsible for its own operations, employees, contractors, and compliance with applicable law, and is not an employee, agent, or franchisee of GoFlyAdventure.
53. Notices
- GoFlyAdventure may provide notices to a User by email to the address associated with the User's account, by posting on the platform, or by other electronic means, and such notices are deemed received when sent, or, if posted on the platform, when made available.
- A User wishing to send a legal notice to GoFlyAdventure must do so in writing to the contact information set out in the "Contact Information" section of this Agreement, and such notice is deemed received on GoFlyAdventure's actual confirmed receipt.
- Notices under this section are in addition to, and do not replace, any notice or complaint mechanism described elsewhere in this Agreement, including the platform's help center.
54. No Waiver; Cumulative Remedies
- No failure or delay by GoFlyAdventure in exercising any right under this Agreement operates as a waiver of that right, and no single or partial exercise of any right precludes any other or further exercise of that right or the exercise of any other right.
- A waiver of any provision of this Agreement is effective only if made in writing and signed by an authorized representative of GoFlyAdventure and applies only to the specific instance for which it is given.
- The rights and remedies provided in this Agreement are cumulative and not exclusive of any other rights or remedies available at law or in equity.
55. Anti-Bribery and Anti-Corruption Compliance
- GoFlyAdventure conducts its business in compliance with applicable anti-bribery and anti-corruption laws, including the U.S. Foreign Corrupt Practices Act, the UK Bribery Act 2010, and equivalent legislation in other jurisdictions in which GoFlyAdventure operates.
- Users and Suppliers must not offer, promise, give, request, or accept any bribe, kickback, or improper advantage in connection with a Booking, a Supplier relationship, or any other dealing with GoFlyAdventure.
- GoFlyAdventure may suspend or terminate a User's or Supplier's access to the platform where GoFlyAdventure reasonably believes a violation of this section has occurred.
56. Language of Agreement; Headings and Interpretation
- This Agreement is drafted in the English language. Any translation provided for convenience is not authoritative, and the English-language version prevails in the event of any conflict, except where applicable Mandatory Local Law requires that a local-language version prevail for Users in a particular jurisdiction.
- Headings used in this Agreement are for convenience only and do not affect its interpretation.
- The words "include," "includes," and "including" are deemed to be followed by the words "without limitation." References to "writing" or "written" include electronic communications permitted under the "Electronic Signatures and Contract Formation" section of this Agreement.
57. Third-Party Beneficiaries
- Except as expressly stated in this Agreement, this Agreement does not confer any right or remedy on any person other than the User and GoFlyAdventure, and no Supplier or other third party may enforce any term of this Agreement as a third-party beneficiary.
- Where this Agreement expressly states that a Supplier or a Payment Processor may rely on a specific provision, that provision may be enforced by that Supplier or Payment Processor solely to the extent expressly stated.
58. Feedback and Suggestions
- If a User submits feedback, ideas, or suggestions regarding the platform ("Feedback"), GoFlyAdventure may use, modify, and incorporate that Feedback into the platform without obligation or compensation to the User.
- Users grant GoFlyAdventure a perpetual, irrevocable, worldwide, royalty-free license to use any Feedback submitted, and agree that such Feedback is not confidential unless expressly agreed otherwise in writing.
- GoFlyAdventure is under no obligation to implement, respond to, or maintain the confidentiality of any Feedback submitted by a User.
59. Suspension for Emergency or Safety Reasons
- GoFlyAdventure may temporarily suspend or restrict access to the platform, or to a specific Booking function, where reasonably necessary to respond to a Force Majeure event, a public health emergency, a safety or security threat, or a directive of a competent Regulator.
- GoFlyAdventure will use reasonable efforts to notify affected Users of a suspension under this section and to restore normal platform functionality as soon as reasonably practicable.
- A suspension under this section itself does not entitle a User to compensation from GoFlyAdventure, without prejudice to any right the User may have directly against a Supplier or Payment Processor.
60. Complaints Handling Procedure
GoFlyAdventure aims to resolve User complaints promptly and fairly.
- A User with a complaint about a Booking, the platform, or a Supplier should first contact GoFlyAdventure's customer support through the platform's help center, providing the Booking reference and a description of the issue.
- GoFlyAdventure will acknowledge a complaint within a reasonable time and will endeavor to provide a substantive response, or an expected timeline for resolution, as soon as reasonably practicable.
- Where a complaint concerns the performance of a Travel Product itself, GoFlyAdventure will use reasonable efforts to facilitate communication between the User and the relevant Supplier, without prejudice to GoFlyAdventure's status as a non-party to the underlying travel service contract.
- If a complaint is not resolved to the User's satisfaction, the User may escalate the matter through the dispute resolution mechanisms described in the "Dispute Resolution" section of this Agreement, or, where applicable, the jurisdiction-specific Alternative Dispute Resolution and ombudsman schemes described in the "Worldwide Jurisdictional Compliance" and "Albania — Home Jurisdiction Compliance" sections of this Agreement.
61. Severability of Jurisdiction-Specific Provisions
- If any jurisdiction-specific provision of this Agreement is found by a competent court or Regulator to be invalid, unenforceable, or inconsistent with the Mandatory Local Law of the relevant jurisdiction, that finding affects only the application of that provision in that jurisdiction and does not affect the validity of that provision in any other jurisdiction, or the validity of any other provision of this Agreement.
- Where a jurisdiction-specific provision is held invalid or unenforceable, GoFlyAdventure will apply the closest lawful equivalent measure in that jurisdiction that achieves substantially the same purpose, to the extent reasonably practicable.
62. Loyalty, Promotions, and Discount Codes
GoFlyAdventure may, from time to time, offer promotional discount codes, referral incentives, or loyalty benefits to Users.
- Promotional codes and discounts are subject to the specific terms disclosed at the time they are offered, including eligibility criteria, expiration dates, minimum booking values, and applicable Travel Products.
- GoFlyAdventure reserves the right to modify, suspend, or discontinue any promotion, discount code, or loyalty program at any time, including after a User has enrolled, subject to honoring benefits already earned in accordance with the terms disclosed at the time of enrollment.
- Promotional codes have no cash value, are not transferable or redeemable for cash except where required by applicable law and may not be combined with other offers unless expressly stated.
- GoFlyAdventure may revoke a promotional benefit and reverse any associated discount where it reasonably determines that the promotion was obtained through fraud, abuse, or violation of this Agreement.
63. Gift Cards and Platform Credit
- Where GoFlyAdventure issues gift cards or platform credit, such gift cards or credit are subject to the specific terms disclosed at the time of issuance, including any expiration date and restrictions on the Travel Products for which they may be redeemed.
- Gift cards and platform credit have no cash value except where required by applicable law, are non-transferable unless expressly stated, and cannot be redeemed for cash, exchanged, or reloaded except as expressly permitted.
- GoFlyAdventure is not responsible for lost, stolen, or unauthorized use of a gift card or platform credit code once issued to a User, except as required by applicable law.
64. Currency Display and Rounding
- The platform may display estimated prices in the User's local currency for convenience, based on exchange rates that fluctuate and are updated periodically.
- The currency and amount charged to the User's payment method is confirmed at checkout and may differ from an earlier estimated display due to exchange rate movement, rounding, or Supplier price changes.
- Users whose payment method is denominated in a different currency than the currency charged by GoFlyAdventure or the Supplier may incur additional currency conversion fees imposed by their card issuer or bank, for which GoFlyAdventure is not responsible.
65. Customer Support Availability
- GoFlyAdventure provides customer support through the platform's help center, including a self-service knowledge base and a channel for direct inquiries.
- Customer support availability, response times, and supported languages may vary by region and are described in further detail through the platform's help center.
- For urgent matters arising during an active trip, Users should also contact the relevant Supplier directly using the contact details provided in the Booking confirmation, in addition to contacting GoFlyAdventure.
66. Age of Majority and Parental Consent
- The platform is intended for use by individuals who have reached the age of majority in their jurisdiction. GoFlyAdventure does not knowingly permit unaccompanied minors to create an account or make a Booking.
- Where a Booking includes a minor as a traveler, the adult Customer making the Booking is responsible for ensuring compliance with any Supplier or destination-specific requirements applicable to minors, including consent forms, guardian documentation, or age-verification requirements.
- GoFlyAdventure reserves the right to request proof of age or guardian consent in connection with a Booking involving a minor, and to decline or cancel a Booking where such requirements are not met.
67. Reviews Moderation and Removal
GoFlyAdventure encourages honest User reviews and applies moderation standards to maintain their reliability.
- GoFlyAdventure may remove, hide, or decline to publish a review that it reasonably determines to be fraudulent, defamatory, abusive, unrelated to the relevant Travel Product, or in violation of this Agreement.
- A Supplier who disputes the accuracy of a review may submit a request for review through the platform's help center; GoFlyAdventure will assess such requests against its moderation standards but does not guarantee removal of a review solely because a Supplier disputes it.
- GoFlyAdventure does not independently verify the factual accuracy of User reviews and disclaims liability for the content of reviews submitted by Users.
68. Account Deactivation and Data Retention
- A User may request deactivation of their account at any time through the platform's help center. Account deactivation does not cancel any existing confirmed Booking, which remains subject to the applicable cancellation policy.
- Following account deactivation, GoFlyAdventure retains personal data only for as long as necessary to comply with applicable legal, tax, accounting, or dispute-resolution obligations, consistent with the "Data Protection and Privacy" section of this Agreement.
- GoFlyAdventure may retain anonymized or aggregated data derived from a deactivated account for analytics and platform improvement purposes without further obligation to the former User.
69. Health and Safety Advisories
- GoFlyAdventure recommends that Users consult official government travel advisories, health organization guidance, and destination-specific entry requirements before booking or departing on any trip.
- Where a government authority issues travel advisory, health warning, or entry restriction affecting a booked destination, GoFlyAdventure will make reasonable efforts to notify affected Users, but does not guarantee the timeliness or completeness of any such notification.
- Users are responsible for making their own informed decision about whether to travel in light of any advisory, and for understanding the cancellation and refund implications under the applicable Supplier policy and the "Force Majeure" section of this Agreement.
70. Environmental and Sustainability Statement
- GoFlyAdventure supports Users in making informed choices about the environmental impact of their travel, including, where available, displaying Supplier-provided sustainability information such as certifications or carbon-offset options.
- GoFlyAdventure does not independently verify Supplier sustainability claims and disclaims liability for the accuracy of any environmental or sustainability representation made by a Supplier.
- Any carbon-offset or sustainability contribution option offered through the platform is provided by a third-party program, and GoFlyAdventure does not guarantee the environmental outcome of any such contribution.
71. Group Bookings and Corporate Accounts
- Where a User books multiple Travel Products on behalf of a group, or registers a corporate account for business travel management, that User represents that they are authorized to bind each traveler or the represented business to the applicable Booking terms.
- Group and corporate bookings may be subject to additional terms, including different deposit, payment, and cancellation schedules, which will be disclosed at the time of booking and, where applicable, in a separate corporate account agreement.
- GoFlyAdventure reserves the right to require a single designated point of contact for a group or corporate booking for purposes of communications, modifications, and cancellations under this Agreement.
72. Force Majeure Notification Procedure
This section supplements the "Force Majeure" section of this Agreement with the procedure GoFlyAdventure follows when a Force Majeure event affects a Booking.
- Where GoFlyAdventure becomes aware that a Force Majeure event is reasonably likely to affect a confirmed Booking, it will use reasonable efforts to notify affected Users through the contact details associated with their account.
- GoFlyAdventure will provide any information received from the affected Supplier regarding alternative arrangements, rebooking options, or refunds, but does not independently guarantee the availability of any such alternative.
- A Force Majeure event does not automatically entitle a User to a refund from GoFlyAdventure; refund eligibility remains governed by the Supplier's policy and applicable Mandatory Local Law.
73. Final Legal Acknowledgement
User Acknowledgement
BY ACCESSING, BROWSING, REGISTERING ON, OR USING THE PLATFORM IN ANY MANNER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THIS TERMS OF USE AGREEMENT IN ITS ENTIRETY, INCLUDING ALL DISCLAIMERS, LIMITATIONS OF LIABILITY, INDEMNIFICATION OBLIGATIONS, DISPUTE RESOLUTION PROVISIONS, AND THE CLASS ACTION WAIVER.
Intermediary Acknowledgement
You acknowledge that GoFlyAdventure is a pure intermediary platform and does not own, operate, manage, control, inspect, guarantee, or provide the travel products and services listed by Suppliers. The contractual relationship for travel services exists exclusively between you and the Supplier.
Governing Law
This Agreement is governed by the laws of Albania. Any disputes shall be resolved in accordance with Section 30 (Dispute Resolution) of this Agreement.
74. Legal Review Disclaimer
IMPORTANT
These Terms of Service constitute the entire agreement between the User and GoFlyAdventure regarding the use of the Platform and shall remain in full force and effect until amended or replaced by the Company in accordance with these Terms.
