Terms of Service
The rules that apply when travellers, providers, and visitors use GoFlyAdventure.
Introduction and Company Information
These Terms of Service ("Terms") govern access to and use of GoFlyAdventure's websites, applications, provider portal, booking tools, communications, and related services (together, the "Platform"). By accessing or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.
GoFlyAdventure is operated by GoFlyAdventure (operated by GoFlyAdventure L.L.C, Tirana, Albania, registration no. 123 - 123). GoFlyAdventure is an online travel and adventure marketplace established in the European Union, connecting travellers with independent hotels, resorts, campsites, activity operators, tour operators, transport providers, guides, and other travel-service providers across the EU, EEA, and other supported countries.
These Terms apply to:
- Visitors who browse the Platform without creating an account.
- Registered travellers who search for, book, or manage travel and adventure services.
- Business users and providers who list, offer, or manage services through the Platform.
- Anyone who submits content, reviews, reports, or communications through the Platform.
Additional service-specific terms, provider agreements, cancellation policies, and checkout disclosures may apply to particular bookings or provider relationships. Where those terms are presented before booking or during provider onboarding, they form part of your agreement with us or with the relevant provider, as applicable.

Definitions
In these Terms, the following definitions apply unless the context requires otherwise:
- GoFlyAdventure, we, us, and our
- The operator of the Platform, GoFlyAdventure (operated by GoFlyAdventure L.L.C, Tirana, Albania, registration no. 123 - 123).
- Platform
- GoFlyAdventure's websites, mobile applications, provider portal, booking tools, communications systems, and related services that enable travellers and providers to interact.
- Traveller
- A person who searches for, requests, books, or uses travel or adventure services through the Platform, whether or not they hold a registered account.
- Consumer
- A natural person who uses the Platform for purposes that are outside their trade, business, craft, or profession.
- Provider
- An independent business or professional that lists, offers, or performs travel or adventure services through the Platform, including hotels, resorts, campsites, activity operators, tour operators, transport providers, and guides.
- Business User
- A provider or other user acting for purposes relating to their trade, business, craft, or profession.
- Listing
- A provider's published offer on the Platform, including descriptions, photographs, prices, availability, policies, and other information shown to travellers.
- Travel Service
- Any accommodation, transport, activity, tour, guide service, equipment rental, or other travel-related service offered through the Platform.
- Booking
- A request or confirmed reservation for a Travel Service made through the Platform.
- Booking Confirmation
- A durable confirmation issued when a Booking is accepted, identifying the contracting provider or organiser and the material terms of the reservation.
- Provider Agreement
- The separate commercial agreement between GoFlyAdventure and a provider governing listing, booking, payment, commission, and related platform obligations.
- Service-Specific Conditions
- Terms, policies, house rules, safety requirements, and other conditions applying to a particular Listing or Booking, as disclosed before confirmation.
- Package
- A combination of travel services that may qualify as a package under applicable package-travel legislation, depending on how the services are selected, presented, priced, purchased, and contracted.
- User Content
- Reviews, ratings, messages, photographs, reports, appeals, and other material submitted by users through the Platform.
- Applicable Law
- The laws and regulations that apply to a user, Booking, or service, including EU, EEA, and national consumer, travel, data-protection, and platform-regulation law.
GoFlyAdventure's Role
GoFlyAdventure operates a marketplace that enables travellers to discover, compare, and book travel and adventure services offered by independent providers. We facilitate discovery, booking, communication, payment collection, refunds, customer support, verification, and dispute resolution, but the legal role we play may vary depending on the specific booking and checkout structure.
For standalone marketplace bookings, the provider identified during checkout is normally responsible for performing the booked Travel Service. Before you confirm payment, the Platform must show the provider's legal name, trader status, contact information, service details, cancellation conditions, and other information required by Applicable Law.
- GoFlyAdventure may act as a booking facilitator, payment facilitator, or support intermediary for certain transactions.
- Where GoFlyAdventure legally acts as organiser, retailer, contracting trader, merchant of record, or another regulated role, the mandatory duties attached to that role apply.
- Checkout information and booking-specific disclosures take precedence over any general statement in these Terms where they differ.
- Verification, badges, or business checks indicate that certain information has been reviewed through permitted sources; they do not guarantee the quality, safety, legality, suitability, availability, or performance of any service.
Eligibility and Accounts
To use the Platform, you must meet the following requirements:
- You must be at least 18 years old or otherwise have the legal capacity, or valid permission from a parent or legal guardian, required under the law applicable to you. Certain services may impose a higher minimum age.
- You must provide complete and accurate information when creating an account, making a Booking, or communicating through the Platform.
- You must keep your login credentials secure and notify us promptly of any unauthorised access to your account.
- You must not impersonate another person or business, or create accounts for fraudulent, abusive, or unlawful purposes.
Providers must be legally capable of offering their services and entering into a commercial relationship with GoFlyAdventure under the Provider Agreement. Providers are responsible for ensuring that their representatives and staff who use the Platform are authorised to do so.
We may refuse, suspend, or close accounts where we reasonably believe that eligibility requirements are not met, that information is false or misleading, or that continued access would create legal, safety, or security risk.
Providers and Trader Status
Unless checkout or the Booking Confirmation expressly states otherwise, providers operate independently and contract directly with travellers for the performance of booked services. Providers remain responsible for their own legal compliance, service delivery, and customer obligations.
Each provider is responsible for:
- The accuracy and completeness of Listings, including descriptions, photographs, prices, availability, and policies.
- Having the legal right to offer the advertised Travel Service.
- Obtaining and maintaining licences, registrations, permits, certifications, and insurance required by Applicable Law.
- Providing health, safety, accessibility, and consumer information that travellers need to make an informed decision.
- Taxes, invoicing, and regulatory reporting relating to their services.
- Honouring confirmed bookings and communicating material changes promptly.
- Applying cancellation and refund commitments disclosed before booking.
- Disclosing risks, physical requirements, age limits, equipment needs, weather restrictions, and accessibility limitations.
- Complying with employment, subcontracting, transport, tourism, accommodation, and local laws.
Provider business information may be verified through business registers, official databases, supporting documents, electronic identification, or other reliable sources where legally permitted or required. Verification documents and sensitive compliance materials are handled confidentially and are not publicly exposed on the Platform.
Bookings and Contract Formation
A Booking is formed through the following sequence:
- The traveller selects a Travel Service and reviews material information about the provider, service, and applicable policies.
- The traveller is shown the total payable price, including taxes, mandatory charges, platform or service fees, deposits, and any amount due later.
- The traveller reviews provider terms, cancellation rules, and Service-Specific Conditions.
- The traveller submits the Booking request and payment details.
- A contract is formed only when the Booking is accepted and a Booking Confirmation is issued, unless checkout expressly states a different formation point.
An automated acknowledgement of receipt is not necessarily acceptance. Until a Booking Confirmation is issued, a provider may decline a request or a payment may fail, in which case no binding reservation is created.
The Booking Confirmation must identify the contracting provider or organiser and must be made available on a durable medium, such as email or a downloadable confirmation within the Platform.
Combined Bookings, Packages, and Package-Travel Rights
Some combinations of accommodation, passenger transport, vehicle rental, and other tourist services may qualify as a package under applicable package-travel legislation. This can depend on how the services are selected, presented, priced, purchased, and contracted. Where a booking qualifies as a package, the traveller will receive the legally required pre-contractual information identifying the organiser, the applicable package-travel rights, responsibility for performance, assistance arrangements, cancellation rights, refund obligations, and insolvency protection before being bound by the booking.
- Checkout-specific package information overrides inconsistent general marketplace wording in these Terms.
- GoFlyAdventure will not use contractual labels to remove rights that apply by law.
- A combined cart must not be launched as an unclassified generic checkout.
- Bookings are classified internally using a booking-level travelArrangementType such as standalone_service, separate_services, or package. This classification is determined by the booking structure and is not a user-editable field.
- The final legal and product classification of combined travel checkout must be approved before such checkout is enabled.
- Package-travel status: [TO_BE_CONFIRMED]. Insolvency protection provider, if applicable: [IF_APPLICABLE].
Prices, Taxes, Fees, and Payments
Before payment, travellers must be shown:
- The base price of the selected service.
- Applicable taxes.
- Mandatory provider charges.
- Platform or service fees, where charged.
- The currency of payment.
- Any deposit or prepayment amount and any balance due later.
- Cancellation costs that may apply.
- The total payable price.
Optional extras must not be preselected. You must actively choose any add-ons before they are included in the payable amount.
Payments may be processed by regulated third-party payment providers. Unless we expressly state otherwise in the checkout flow, GoFlyAdventure does not store complete payment-card credentials. Payment-provider terms and privacy information may also apply to your transaction.
- Currency conversion may be performed by the payment provider or your card issuer, which may apply its own exchange rates or fees.
- Providers authorise permitted deductions for commissions, refunds, fees, chargebacks, reversals, and legally required adjustments according to the Provider Agreement.
- GoFlyAdventure does not impose a payment-method surcharge exceeding what Applicable Law permits.
Cancellations, Changes, Refunds, and No-Shows
Each Listing displays a cancellation policy before booking. Different rooms, rate plans, activities, transport services, and providers may have different policies. The policy shown at checkout forms part of the booking contract.
Refund timing may depend on the provider, payment processor, bank, and mandatory law. GoFlyAdventure may facilitate refunds where we are contractually or legally responsible to do so, but we do not promise a fixed refund timeframe unless that timeframe is technically and legally guaranteed for the specific booking.
- Provider cancellation policies cannot remove mandatory traveller rights.
- Package bookings have separate mandatory protections where applicable.
- No-show and late-arrival consequences must be disclosed before checkout.
- Providers must not impose undisclosed cancellation fees after booking.
- Changes to confirmed bookings are subject to provider availability and the applicable modification policy.
Traveller Responsibilities and Adventure Risks
Travellers are responsible for using the Platform lawfully and preparing appropriately for booked services. In particular, travellers must:
- Review service requirements, restrictions, and Service-Specific Conditions before booking.
- Provide accurate participant and contact information.
- Follow lawful safety instructions given by providers and their staff.
- Disclose information necessary for safe participation where legally appropriate, such as relevant health or mobility needs when requested for safety purposes.
- Carry required travel documentation, tickets, permits, and identification.
- Arrive on time and respect check-in, meeting-point, and departure requirements.
- Respect local law, property, staff, residents, wildlife, and the environment.
- Not participate while impaired by alcohol, drugs, or other substances where that creates a safety risk.
Certain travel and adventure activities involve inherent risks. Providers must disclose material known risks and required precautions. Travellers remain responsible for following safety instructions and assessing whether a service is suitable for them. Nothing in these Terms excludes liability that cannot lawfully be excluded.
Ranking, Search Results, and Recommendations
Search results, recommendations, and listing order may be influenced by automated systems designed to show relevant and trustworthy options. The main factors that may affect ranking include:
- Relevance to search criteria.
- Location and travel dates.
- Availability for the requested period.
- Price and perceived value.
- Listing completeness and quality.
- Verified business information.
- Ratings and review quality.
- Cancellation flexibility.
- Provider responsiveness.
- Booking performance and reliability.
- Popularity and traveller interest.
- Safety, compliance, or trust signals.
- Traveller preferences, where permitted by law and settings.
- Promotional placement, if introduced and clearly labelled.
Providers cannot currently purchase an undisclosed improvement in organic ranking. If sponsored or paid placement is introduced later, it will be visibly labelled and its influence on visibility will be explained.
We do not publish confidential algorithm source code, anti-fraud signals, or security-sensitive ranking parameters that could undermine platform integrity.
Reviews and User Content
Reviews and other User Content must be based on genuine experience, relevant to the service or platform interaction, respectful, and free from unlawful, deceptive, threatening, discriminatory, defamatory, or privacy-invasive material. Undisclosed incentives, conflicts of interest, and fake reviews are prohibited.
By submitting User Content, you grant GoFlyAdventure a limited, non-exclusive licence to host, reproduce, format, translate, display, and distribute that content as reasonably necessary to operate, secure, and promote the Platform. You retain ownership of your content.
We may moderate, remove, restrict, or decline to publish User Content that violates these Terms, Applicable Law, or our moderation policies. Where content is removed or restricted, affected users may have access to an appeal process where required. We may use automated tools and human review to detect fraud, abuse, and policy violations.
Prohibited Use and Illegal Content
You must not use the Platform for unlawful, harmful, or abusive purposes. Prohibited conduct includes, without limitation:
- Fraud, fake listings, fake reviews, or payment abuse.
- Offering or booking unlicensed or illegal services.
- Exploitation, trafficking, or other serious criminal activity.
- Discrimination prohibited by law.
- Intellectual-property infringement.
- Uploading malware or interfering with Platform security or availability.
- Scraping or data extraction that violates law or our rights.
- Circumventing security, identity, or payment controls.
- Harassment, threats, or intimidation.
- Misleading prices, hidden mandatory charges, or deceptive availability.
- Offering dangerous services without required disclosures or controls.
- Content that infringes privacy or other legal rights.
Reports of allegedly illegal content should identify the relevant listing or content URL, explain why the content is allegedly illegal, provide supporting information, and include reporter contact details where required by law.
Moderation and Enforcement
GoFlyAdventure may investigate reports, request additional information, restrict visibility, pause a listing, remove content, suspend transactions, restrict or suspend an account, terminate access, and notify authorities where legally required.
Enforcement actions should be proportionate and based on Applicable Law, these Terms, provider terms, safety requirements, fraud prevention, and platform security needs.
Where required by law, we will provide a clear statement of reasons that includes the action taken, its duration where relevant, the main basis for the decision, whether automated tools were materially involved, and available appeal or complaint options. Moderation decisions are not described as always final where review or appeal is available.
Provider Restriction, Suspension, and Termination
GoFlyAdventure may restrict, suspend, or terminate provider access where reasonably necessary for legal compliance, safety, fraud prevention, repeated policy breaches, or platform security.
- A provider should receive the reason for listing restriction or account suspension before or when the action takes effect, unless law or urgent safety requirements prevent this.
- Full provider-account termination should ordinarily include advance notice and reasons where applicable under platform-to-business and related law.
- Emergency, fraud, cybersecurity, repeated infringement, legal, or safety cases may justify immediate action without prior notice.
- Providers must have access to a complaint or appeal process through the channels identified in these Terms.
- Reinstatement must restore appropriate access where a decision is reversed.
- Exact statutory notice periods and exceptions must be reviewed for the final country of establishment and business size.
Provider Data Access
Providers may access data reasonably necessary to operate their business on the Platform, including:
- Their listing data and performance information.
- Booking information needed to perform services.
- Traveller information necessary for fulfilment, safety, and legal compliance.
- Payout and transaction records relating to their account.
- Reviews and communications routed through the Platform.
Providers do not receive unnecessary traveller data. Providers must not use booking data for unrelated marketing without a separate lawful basis under data-protection law. Certain fraud, risk, platform-wide analytics, or confidential data may not be shared.
Access after termination of a provider relationship depends on Applicable Law, retention duties, security restrictions, and the Provider Agreement.
Intellectual Property
GoFlyAdventure and its licensors own the Platform, including the GoFlyAdventure name, logo, interface, code, original graphics, database structure, written content, and brand assets. Except as permitted by these Terms or Applicable Law, you may not copy, modify, distribute, sell, or create derivative works from Platform materials.
You may use the Platform for personal or authorised business purposes in accordance with these Terms. Providers retain their own trademarks, photographs, descriptions, and other original materials, subject to the operational licence granted to GoFlyAdventure to host and display Listings.
Platform Availability and Changes
GoFlyAdventure may maintain, improve, modify, or discontinue features of the Platform. We do not guarantee uninterrupted or error-free availability.
Material changes to the Platform will not automatically alter the rights attached to confirmed bookings. Existing booking rights remain governed by the Booking Confirmation and information presented at checkout, subject to mandatory law.
Liability
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence where such exclusion is prohibited, breach of mandatory consumer rights, data-protection obligations, or any other liability that cannot legally be limited.
For services performed by independent providers, the provider remains responsible for its own acts and performance, except where GoFlyAdventure has a separate legal responsibility under Applicable Law or the specific booking structure.
GoFlyAdventure remains responsible for obligations imposed on it by law. Any limitation applying to business users must be reasonable, proportionate, and assessed under the governing national law. Consumer statutory rights remain unaffected.
Insurance
Providers are responsible for obtaining and maintaining business, liability, and activity insurance required by Applicable Law for the services they offer.
Travellers should assess whether personal travel, health, cancellation, equipment, or activity insurance is appropriate for their trip and chosen services. GoFlyAdventure does not represent that every loss or incident will be covered by platform processes, provider insurance, or third-party policies.
A verified listing or business check does not automatically prove that every possible risk is insured.
Force Majeure and Extraordinary Circumstances
Neither GoFlyAdventure nor providers are responsible for failure or delay caused by events outside reasonable control, including severe weather, natural disasters, war, government restrictions, public-health emergencies, infrastructure failures, transport disruption, labour disputes, or other extraordinary circumstances.
Where such events affect a booking, remedies will depend on the booking terms, provider policies, and mandatory traveller rights concerning cancellation, refunds, assistance, re-routing, or package-travel protections. Nothing in this section removes rights that apply by law.
Privacy
Our processing of personal data is described in the Privacy Policy. Optional consent for marketing or non-essential cookies may be withdrawn at any time without affecting processing already lawfully performed on another legal basis.

Changes to the Terms
We may update these Terms from time to time. The effective date and version at the top of this document will be updated when changes take effect.
For consumers, material changes apply prospectively. Confirmed bookings continue under the terms presented during booking unless Applicable Law requires otherwise or you expressly agree to different terms for a specific interaction.
For providers, material changes must be notified on a durable medium with an appropriate notice period required by applicable platform-to-business law. Providers may terminate their relationship before material changes take effect where legally required.
Emergency legal, fraud, malware, data-breach, or cybersecurity changes may require shorter or immediate implementation. Continued passive browsing alone does not constitute acceptance of every material change where Applicable Law requires express or informed consent.

We will acknowledge complaints and review them using internal procedures appropriate to the issue. Response times may vary depending on complexity, legal obligations, and the information provided, and we do not guarantee an unrealistic fixed resolution deadline for every case.
Information about any competent consumer alternative dispute resolution body will be published once selected. Where applicable under the Digital Services Act, information about DSA-certified out-of-court dispute settlement bodies may also be provided.
Governing Law and Jurisdiction
These Terms are governed by the laws of Albania, without depriving consumers of mandatory protections available under the law of their country of habitual residence where those protections apply.
Consumers may bring proceedings in any court available to them under mandatory Applicable Law. Separate jurisdiction provisions may apply to business users under the Provider Agreement.
Competent courts for business users, where permitted by law: Albanian courts.
General Terms
These Terms, together with the Privacy Policy, Booking Confirmation, Service-Specific Conditions, and any provider or checkout terms presented to you, constitute the entire agreement between you and GoFlyAdventure regarding use of the Platform, except where a separate written agreement applies.
- Order of precedence: checkout disclosures and Booking Confirmation terms prevail over these general Terms where they conflict for a specific booking; these Terms prevail over general help-centre summaries.
- Severability: if any provision is invalid or unenforceable, the remaining provisions remain in effect.
- No waiver: failure to enforce a provision does not waive our right to enforce it later.
- Assignment: GoFlyAdventure may assign its rights and obligations in connection with a reorganisation, merger, or sale of business assets, subject to Applicable Law. You may not assign your rights without our consent, except where mandatory law allows otherwise.
- Third-party rights: these Terms do not create enforceable rights for third parties, except where Applicable Law provides otherwise.
- Language and translation: translated versions may be provided for convenience. The controlling language for each user relationship must be determined after professional legal review and in accordance with mandatory consumer law.
- Electronic communications: you consent to receive contractual and transactional communications electronically where permitted by law.
